Marc Goldsand is a Founding Partner of Goldsand Friedberg. Marc has the distinction of being Board Certified in Health Law by the Florida Bar. He primarily focuses in the intersecting areas of digital health and value-based care. He works with an array of clients, from seed-level startups through publicly-traded companies.

Prior to founding Goldsand Law (now Goldsand Friedberg), Marc was a partner in the health care group of Cozen O’Connor, an AMLAW 100 law firm.

Experience


Some of Marc’s representative matters and accomplishments include the following:

  • Counsel to Telehealth Companies. Counsel for multi-state digital health businesses in, among other areas, pediatrics, diabetes management, behavioral health, sexual health, womens’ health, metabolic health and weight loss, dermatology, kidney disease, longevity medicine, and other specialties and provided strategic and legal guidance on telehealth modalities, corporate practice of medicine, business development and expansion, contracting, compliance, and other matters.

  • Outside Fractional General Counsel. Strategic C-Suite level support, including with respect to business structuring, marketing strategies, staffing issues, and broader market context.

  • Value-based Care. Counsel for companies with respect to risk-based contracting and regional market trends and business structures.

  • Telehealth and Medicare Compliance. Extensive experience advising clients on telehealth payment and reimbursement issues under the Medicare program, including billing requirements and coverage, modifiers, conditions for payment, conditions of participation, billing patients for noncovered services, reassignment, credentialing, and offshoring of providers, among other issues.

  • Virtual Media. Advised in the business structure and assisted with addressing regulatory and fraud and abuse concerns with a digital health virtual media company.

  • Healthcare M&A. Lead counsel in the sale of multi-location medical practice and ACO to a health plan in deal valued in excess of $120 million.

  • Venture Finance Support. Assisted clients with diligence in Series A, Series B, and Series C capital raises with respect to digital health regulatory issues.

  • Incubator. Counsel to multiple start-ups from venture-backed technoloy incubators and accelerators in structuring their digital health businesses and providing strategic and legal advice through growth periods.

  • Clinical Lab. Advised clinical client on fraud and abuse, contracting, and other regulatory and business issues in real time, during explosive Covid-19 growth.

  • School-Based Telehealth, Medicaid Enrollment, and FEPRA. Advised a school-based telemedicine program offering telehealth services across multiple states, without any brick and mortar locations, on the requirements for enrolling in Medicaid programs.

  • Fraud and Abuse. Advised traditional provider and digital health clients on fraud and abuse considerations when establishing pricing models, compensation structures, and marketing strategies, including both state and federal anti-kickback and self-referral (Stark) laws.

  • Recognition/Achievement. Board Certified in the area of health law by the Florida Law.

Education


Marc graduated with a B.B.A. from the Goizueta Business School at Emory University in 2002 and with a JD from the University of Miami School of Law, magna cum laude, in 2007. Marc was also a member of the University of Miami Law Review.
